  1. WHO WE ARE

1.1 We are Kebur Concrete Products, trading as Kebur Garden Materials, a supplier and installer of landscaping materials. These Terms and Conditions of Website also apply to Kebur Stone Imports Ltd (Company No. 10059884, Registered address: James House, 153 Grosvenor Road, Aldershot GU11 3EF), our affiliated company, that sources products on behalf of Kebur Garden Materials and supplies to other commercial landscaping companies.

  1. USING OUR WEBSITE

2.1 Our website, www.kebur.co.uk has no charge for use. In using this website, you agree to these Terms and Conditions of Website. If you do not agree to be bound by these terms and conditions, do not use, or access this website. You must read and accept all of these terms and conditions before you may use or access the website in any way.

2.2 Online orders are also subject to our Terms & Conditions of Sale. These will not affect your statutory rights. We reserve the right to update our Terms and Conditions of Website and Terms and Conditions of Sale. Changes will be updated on this website.

2.3 Material on this website must not be republished online or offline without our permission.

  1. PRICING

3.1 All prices shown on the website are in Pounds Sterling (£) and are inclusive of VAT at the current rate.

3.2 All prices will be as advertised on our website but may be subject to change through circumstances beyond our control. Certain items may have a minimum order quantity. If this is the case we will let you know and you will have the opportunity to cancel.

3.3 The Customer will be liable to pay extra for delivery and it might not be possible for us to deliver to some locations.

  1. REGISTRATION

4.1 To create an online account you must be a minimum of 18 years old. All details must be correct and changes must be notified.

  1. PASSWORD

5.1 The password you create is your responsibility and must be kept confidential. If you think this has been compromised, we must be informed immediately as you are responsible for all activities which have occurred using your password. We recommend using two factor authentication and a strong password using at least 12 characters that are a combination of upper and lower case alphanumeric characters, symbols and numbers.

6.1 In the unlikely event that security is breached we may request that your password be changed. We reserve the right to suspend your account and/or refuse access to our website, terminate or remove an account, edit content or cancel orders.

  1. ORDERING ONLINE

7.1 When you order online, your order is subject to our Terms and Conditions of Sale. All descriptions, drawings, specifications, technical data, including dimensions and illustrations contained on our website are approximations and for guidance only. They should not be relied on by the Customer as precise or construed literally and shall not form part of the Contract. Before placing an order, the Customer is strongly encouraged to view a sample or the full product and should satisfy him or herself as to the specification and suitability for the intended purpose of the goods or services, by such further enquiry of ourselves as they consider necessary.

7.2 We cannot be held responsible for under or over-ordering. Whilst every attempt has been made to provide you with the ability to accurately calculate your product requirements, it is recommended that you check all area calculations before confirming your order. You are advised to print a copy of your order to check that the details are correct and complete before sending it to us, and to keep a copy for your records.

7.3 If no trading account is held, payment must be made in full to enable your order to be processed.

7.4 If the billing details for your order are not the same as the delivery address, Kebur Garden Materials may request additional information. Otherwise, by placing an order, the Customer confirms that they are the person referred to in the billing details.

7.5 Once we have received payment, Kebur Garden Materials will confirm receipt of payment via the email address provided by the Customer on account registration. Subject to availability, Goods will be dispatched to either the billing address or the delivery address notified to us (if different).

7.6 In the unlikely event that the goods are no longer available, or that there has been a pricing mistake, we will let you know; we will give you the opportunity to cancel your order and if you choose to do this there will be no contract between us.

7.7 If once payment has been made, the customer wishes to make a change to an order (such as a delivery address), the order will be cancelled and started again for security purposes. The customer will be liable for the cost of returning goods if they are already in transit.

  1. ACCURACY OF INFORMATION ON THIS WEBSITE

8.1 We do our best to ensure that all information on this site is complete, up to date and accurate. Despite our efforts, however, information may occasionally be incomplete, out of date or inaccurate.

8.2 All specifications, products, descriptions and prices on the site are subject to change at any time without notice. We make all reasonable efforts to display the attributes of our products including the relevant colours. We cannot guarantee that your device will accurately display the true colour of the product.

8.3 We do not warrant the accuracy or completeness of the information and materials provided on this website. The inclusion of products or services on this site does not guarantee their availability at the price displayed. We reserve the right to make changes at any time.

  1. YOUR RIGHT TO CANCEL AN ORDER

9.1 Full details of your cancellation rights are in section 9 of our Terms and Conditions of Sale.

9.2 You may cancel any time from the moment an order is placed and have 14 working days from the day after you receive the goods in which to cancel. All cancellations must be notified by email or letter and include proof of purchase. The cost of returning the goods will be at the customer’s liability and must be within 14 days of cancellation.

9.3 Under Consumer Contracts Regulations 2013, you are not entitled to cancel your order in relation to any goods that are not a stock item, those that are ordered to your specifications, or any that are perishable.

  1. LIABILITY

10.1 You must let us know about any deficiencies, breakages or late deliveries within 48 hours of them occurring.

10.2 If there is a problem with the goods, please notify us immediately by providing full details. If possible provide us with a digital photograph of the problem as this may save time. We will deal with the matter in accordance with your legal rights and your statutory rights will not be affected.

10.3 Upon notification we reserve the right to carry out any of the following:
• Make good any shortages
• Rearrange another suitable delivery date
• Replace defective goods
• Refund items in question

10.4 Our site offers no guarantees or warranties. All risks associated with Internet use are your liability. Errors and omissions are excepted. Inaccuracies should be notified immediately.

10.5 We try to ensure our website is available 24/7 all the year, however, should we encounter any downtime we will not be held liable for its unavailability.

11.1 Any links to third party websites from this website are for your convenience only. They may not have been reviewed and we accept no responsibility for their content.

  1. INTELLECTUAL PROPERTY

12.1 All intellectual property rights, including, without limitation, copyright and trademarks, and all other rights in any documents or materials provided by Kebur Garden Materials to the Customer under the Contract shall belong to Kebur Garden Materials. This includes the website (www.kebur.co.uk) and its underlying software, text, artwork, graphics and images. Without prior written permission, website users and Customers may not copy, alter, publish, broadcast, distribute, sell or transfer any documents or materials belonging to Kebur Garden Materials, unless for their own personal use.

  1. LINKING TO OUR SITE

13.1 You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

13.2 You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

13.3 You must not establish a link to our site in any website that is not owned by you.

13.4 We reserve the right to withdraw linking permission without notice.

14.1 The contract between us shall be governed by English law and English courts will be given jurisdiction to resolve disputes.

14.2 By placing an order with us, you agree to and accept these terms, as well as our Privacy Policy and the Terms and Conditions of Sale.

15.1 Nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable UK law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
